Welcome to ZZPVinder. These terms of service apply to the use of our website and services. By using ZZPVinder, you agree to these terms. Please read these terms carefully before using our services.

1. Definitions

The following terms are used in these terms of service:

  • ZZPVinder: The private limited company ZZPVinder B.V., established in the Netherlands, registered with the Chamber of Commerce, which operates the Platform.
  • User: Any natural or legal person who uses the Platform, including both Freelancers and Clients.
  • Client: A government agency, public sector organization, or other legal entity that posts contracts on the Platform.
  • Freelancer: A self-employed professional (ZZP'er) who uses the Platform to find contracts in the public sector.
  • Services: All services offered by ZZPVinder through the Platform, including but not limited to the job board, matching services, and alert system.
  • Platform: The website zzpvinder.nl and all associated subdomains, applications, and systems.

2. Applicability

These terms of service apply to all use of the Platform and Services of ZZPVinder, as well as to all agreements entered into between ZZPVinder and Users.

By creating an account, using our Services, or visiting our Platform, you accept these terms fully and unconditionally.

Deviations from these terms are only valid if expressly confirmed in writing by ZZPVinder.

3. Account and Registration

To fully use our Services, you must create an account. Registration is free and open to both Freelancers and Clients.

When creating an account, you guarantee that all information provided is accurate, complete, and current. You are responsible for keeping your account information up to date.

As a User, you are required to:

  • Provide accurate and truthful information during registration
  • Keep your account information up to date
  • Keep your login credentials confidential and not share them with third parties
  • Consider all activities under your account as your own

4. Services

ZZPVinder provides a platform that connects freelancers with contracts in the Dutch public sector. Our core services include:

  • A job board with contracts from government organizations and public institutions
  • Matching services to find suitable contracts based on your profile and preferences
  • Personalized email alerts for new contracts that match your profile
  • The ability to create and manage a professional profile
  • Access to market insights and rate information (depending on subscription type)

ZZPVinder acts solely as an intermediary platform. We are not a party to any agreements made between Freelancers and Clients. The responsibility for the execution of contracts lies entirely with the parties involved.

5. Use of Services

The Platform may only be used for legitimate purposes that comply with these terms and applicable laws and regulations.

It is expressly prohibited to:

  • Use the Platform for illegal activities or actions contrary to the law
  • Provide false, misleading, or incorrect information in your profile or applications
  • Send spam or distribute unsolicited commercial messages through the Platform
  • Use automated systems to collect data from the Platform (scraping)
  • Circumvent, compromise, or disrupt the security of the Platform
  • Impersonate another person or organization
  • Post content that is harmful, offensive, discriminatory, or otherwise unlawful

6. Intellectual Property

All intellectual property rights related to the Platform, including but not limited to the software, design, texts, images, and logos, belong to ZZPVinder or its licensors.

Users retain intellectual property rights to content they upload or post on the Platform, such as profile information and CVs. By posting this content, you grant ZZPVinder a non-exclusive, royalty-free license to use this content for providing the Services.

It is not permitted to copy, modify, distribute, or otherwise exploit any part of the Platform without prior written consent from ZZPVinder.

7. Liability

ZZPVinder strives to ensure the Platform and Services function properly, but cannot guarantee they will always be available without interruptions or errors.

ZZPVinder is not liable for the content of vacancies posted by Clients, nor for the quality or execution of contracts. The responsibility for this lies with the respective parties.

To the extent permitted by law, ZZPVinder's liability is limited to direct damages and to a maximum of the amount paid by the User to ZZPVinder for the relevant Services in the preceding twelve months.

ZZPVinder is in no event liable for indirect damages, consequential damages, lost profits, or missed contracts.

8. Privacy

ZZPVinder processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Dutch privacy legislation.

9. Termination

You can terminate your account at any time by logging in and deleting your account through the account settings, or by contacting our customer service.

ZZPVinder reserves the right to suspend or terminate accounts in case of a (suspected) violation of these terms, misuse of the Platform, or other serious reasons.

Upon termination of your account, your personal data will be deleted in accordance with our Privacy Policy, except for data we are legally required to retain.

10. Changes

ZZPVinder reserves the right to modify these terms of service. Material changes will be communicated to Users at least 30 days before they take effect, via email or a notification on the Platform.

By continuing to use the Platform after modified terms take effect, you accept the modified terms. If you do not agree with the changes, you must stop using the Platform and terminate your account.

11. Disputes

These terms of service and all agreements between ZZPVinder and Users are governed by Dutch law.

Disputes arising from or related to these terms or the use of the Platform shall be submitted to the competent court in the Amsterdam district, unless mandatory law provides otherwise.
